Building Control

The Building Control Section is responsible for administering the Building Control Regulations and promoting compliance with the Building Regulations in the Fingal area. Building Control aims to encourage and support building owners, designers and builders in delivering compliant, sustainable, high-quality buildings. The responsibility for compliance with building regulations rests with designers, builders and owners of buildings. 

Building Control deliver effective public oversight of compliance with Building Regulations by inspecting active construction sites and new buildings under construction. Fingal’s Building Control Engineers and Building Control Inspectors carry out a large number of these inspections every year across Fingal.

The Building Control Regulations apply to the design and construction of new buildings, extensions and material alterations to, and certain changes in the use of, existing buildings.

On these pages you will find further information on Disability Access Certs, Fire Safety Certs and Commencement Notices all of which may be submitted online and paperless using the BCMS portal. The BCMS is the national Building Control Management System delivered by the National Building Control and Market Surveillance Office. A BCMS account is required to submit all applications. Building Regulations Enforcement

Councils regulate the design and construction of new buildings, altered buildings or buildings undergoing a change of use to ensure that they are compliant with the Building Regulations including fire safety, accessibility and proper planning and building control procedures.

Construction Products Regulations (CPR) Enforcement

From 8 January 2026, the new Construction Products Regulation (EU) 2024/3110) (CPR 2024) applies across the EU. CPR 2024 replaces the previous Construction Products Regulation (EU 305/2011) (CPR 2011), although certain articles of CPR 2011 will continue to apply until 8 January 2040 under transitional arrangements. 

CE MARKING of construction products covered by harmonised European Standards or European Assessment Documents remains mandatory. Manufacturers, importers and distributors have strengthened obligations under CPR 2024 when placing construction products on the market, and designers, specifiers and builders must ensure they understand the requirements that apply to the products they select. 

Introduction

The Construction Products Regulation (EU) 2024/3110 sets out harmonised rules for the marketing of construction products throughout the EU and is directly applicable in Irish law. CPR 2024 aims to support a well‑functioning single market and contributes to the EU’s green and digital transition, promoting a more modern, resource‑efficient and competitive economy. 

The scope of CPR 2024 has been extended to include used construction products, and the new definition of construction products now explicitly includes 3D‑printed products. The regulation also establishes a Digital Product Passport system that will improve access to environmental and performance information for consumers and industry. 

CPR 2024 strengthens the obligations of manufacturers, importers, distributors, fulfilment service providers and online marketplaces, and enhances market surveillance and consumer protection. It also recognises that Member States continue to retain authority over the regulation of construction works. 

What are the main provisions of CPR 2024?

Building on the framework developed under CPR 2011, the new regulation introduces several modernisation measures, including:

  • Updated harmonised technical specifications
  • A strengthened system for the Assessment and Verification of Constancy of Performance (AVCP)
  • The ability for the European Commission to adopt common specifications when standardisation routes are delayed
  • An improved framework for notified bodies
  • The introduction of a Digital Product Passport to enhance product transparency, traceability and environmental reporting

The European Commission has developed the first CPR Working Plan for 2026–2029, which sets out priorities for future standards and technical development under the new system.  

The Department of Housing, Local Government and Heritage is currently preparing for Ireland’s implementation of CPR 2024 and continues to update national guidance.

Authorised Officers

Fingal County Council has appointed authorised officers under the European Union (Construction Products) Regulations 2025 (S.I. No. 669/2025) for the purposes of carrying out market surveillance and enforcement of the Construction Products Regulation (EU) 2024/3110

These officers have statutory powers to check that construction products placed on the Irish market comply with CPR 2024 and to take action where non‑compliance is identified.
