Noise Abatement Objective and Regulatory Decision

The Aircraft Noise Competent Authority (ANCA) has adopted a noise abatement objective (NAO) for Dublin Airport, which is to limit and reduce the long-term adverse effects of aircraft noise on health and quality of life, particularly at night, as part of the sustainable development of Dublin Airport.

In addition, ANCA has made a regulatory decision  and revised the related report .The regulatory decision and related report contain an assessment of the aircraft noise implications arising from a planning application by the airport authority for Dublin Airport (F20A/0668), seeking to amend prior planning conditions associated with night-time aircraft activity at the airport.

 

ANCA undertook the following environmental assessments in relation to the implementation of the NAO and regulatory decision:

  1. Strategic Environmental Assessment pursuant to Directive 2001/42/EC of the European Parliament and of the Council of 27 June 2001 on the assessment of the effects of certain plans and programmes on the environment and the (European Communities Environmental Assessment of Certain Plans and Programmes) Regulations 2004-2011 (as amended) (the SEA Regulations), and
  2. Appropriate Assessment pursuant to Council Directive 92/43 EEC of 21 May 1992 on the conservation of natural habitats and of wild fauna and flora and the European Communities (Birds and Natural Habitats) Regulations 2011 (as amended).

 

An SEA Statement is available for inspection which summarises –

(i) how environmental considerations have been integrated into the plan or programme, or modification to a plan or programme,

(ii) how

      (I) the environmental report prepared pursuant to article 12,

      (II) submissions and observations made to the competent authority in response to a notice under article 13, and

      (III) any consultations under article 14,

have been taken into account during the preparation of the plan or programme, or modification to a plan or programme,

(iii) the reasons for choosing the plan or programme, or modification to a plan or programme, in the light of the other reasonable alternatives dealt with, and

(iv) the measures decided upon to monitor, in accordance with article 17 of the SEA Regulations, the significant environmental effects of implementation of the plan or programme, or modification to a plan or programme.

 

The NAO, its supporting report, the regulatory decision, and its related report along with the related Strategic Environmental Assessment (SEA) Final Environmental Report, SEA Statement, Natura Impact Statement, and Appropriate Assessment Determination, may be viewed on the ANCA website: www.fingal.ie/aircraftnoiseca/documents-f20a0668 . Hard copies are also available to view or purchase at a fee not exceeding the reasonable cost of making a copy at the ANCA office: County Hall, Main Street, Swords, Co Dublin K67 X8Y2 from Monday to Thursday 9am to 5pm and Friday 9am to 4.30pm (excluding bank holidays) for at least 4 weeks from the date of this notice.

A right to appeal to An Bord Pleanála against the regulatory decision exists under section 37 of the Act of 2000 as read with section 37R.

ANCA’s regulatory decision has been sent to the planning authority of Fingal County Council. The planning authority shall incorporate this regulatory decision in the planning authority’s decision on the application.
